Approver’s Position before Court of Law - Dual Role

Section 306 CrPC (Act 2/1974) stipulates procedures to be adopted in tendering of pardon of the Accused who turns as an Approver.
During the course of Investigation or Inquiry or trial, respective Judicial Officers have got powers to tender of pardon to the Accused who supposed to have been directly or indirectly concerned in or Privy of offence to which that sanction applies.
Even then after tendering of Pardon to the accused by concerned Judicial Officer, he is treated as an Accused. Law contemplates that committing Magistrate has to examine the approver as a witness at the request of the Investigating Agency or the Prosecution, as the case may be before committing the Accused to the Court of Session and to the respective Courts. In some cases, after committal of the Accused is over, in such circumstance, if the accused wants to disclose anything and everything about the crime and about the participation of all including himself, then also the Court of Sessio ....
