In our present day social scenario, everyday there is a rapid increase in crime rates. Simultaneously, there is a vast expansion in the context of Human Rights, Despite the constitutional, legal and judicial safeguards, the Power of ARREST is often abused for various purposes. The Code of Criminal Procedure, 1973-Chapter V (hereinafter to be referred as Cr. P. C.) relates to arrests of individuals. A police officer u/S. 41, Cr. P. C. can arrest a person without ‘warrant’ in a ‘Cognizable Case/Offence’ and in certain other circumstances. (State of Punjab v. Ajaib Singh, AIR 1953 SC 10 : 1953 Cri LJ 180). Thus the Police Personnel is equipped with a huge Power which can be easily misused in its exercise in a wrong and illegal manner. Many persons are also arrested u/Ss. 107, 110, 151, Cr. P. C.
