Concept of Mahr (Dower)

In Pre-Islamic Arabia, the institution of marriage as we know today was not developed and sexual relations were in vogue. Some were temporary and hardly better than prostitution.1 Historically the idea of sale is latent in the law of Mahr.2 In Pre-Islamic Arabia two forms of marriages prevailed. In the “Beena” form, the wife on marriage, didn’t accompany her husband to his home, but continued to remain in her home, where the husband visited her. In this form, it was customary to give on marriage a gift to the wife. This gift was known as“Sadaqi”. In Islam Sadaq simply means a dowry and is synonymous with Mahr (Sale Price). In the other form know as “Baal” marriage, the wife after marriage, accompanied her husband to the matrimonial home, and the husband in consideration of wife’ leaving her parents home, paid some amount to her parents.
