Article 129 of the Constitution of India reads as follows :
“129 Supreme Court to be court of record — The Supreme Court shall be a Court of record and shall have all the powers of such a Court including the power to punish for the contempt of itself”.
Including the Power to Punish for the Contempt of Itself
These words occurring in Article 129 of the Constitution (extracted above) were construed by the Apex Court to mean that the said words confer power on the Supreme Court to punish for the contempt committed against Courts subordinate to it including the High Court. This view was taken in Delhi Judicial Service Association v. State of Gujarat, 1991 Cri LJ 3086 : AIR 1991 SC 2176 and in Re V. C. Mishra, 1995 Cri LJ 3994 : AIR 1995 SC 2348.
