Factories Act, 1948 - Occupier or Manager : How they can Safeguard themselves from Rigours of the Amended Act

The recent amendment to the Factories Act, 1948, has caused much anxity among executives of Factories than any other amendment in the recent past. The imposition of fine which may extend to two lakh rupees and imprisonment for seven years as penalty for any breach of the provisions of the Act, seems to be too much for an Occupier or Manager in large organisations, who remains more as Administrator with the powers having been delegated to his subordinate Officers. The Act also provides safeguards to the Occupier or Manager from its penal pro provisions. He can safeguard himself from the rigours of the Act if he can prove to the satisfaction of the Court, that he is not the actual Offender and someone under him is a responsible for it. The Factories Act, 1948 is a social welfare legislation enacted primarily with the object of protecting workers employed in factories against industrial hazards and ensuring safe and healthy conditions of life and work.
