In a complex growth-driven India, the Industries could hardly countenance anything subversive of discipline. We are therefore hot on indiscipline more so on such misconducts which are immoral. Any behavior of an industrial employee which does not conform to good and uprighteous conduct of a human being or the customs or accepted standards of a civilized society, such as justice, honesty, modesty, etc. may apart from being a criminal offence, constitute an act of industrial misconduct. In Industrial law, the acts of theft, fraud and dishonesty have been treated as acts of misconducts justifying dismissal. This has been the position, which has been exposed in the cases of Bangalore Woollen Cotton and Silk Mills Ltd. v. B. Dasappa AIR 1960 SC 1352, J. K. Cotton Spg. and Wvg. Co. Ltd. v. Its Workmen 1965 (II) LLJ 153 (SC).
