With the motto ‘service before self’, the Indian army strives to protect its citizens from any external aggression. But there are instances when the army personnel get entangled in disciplinary issues, where they go beyond their jurisdiction and end up committing an offence.
While Indian Penal Code (IPC), in its basic form, is a document that enlists all cases and punishments that a person committing any crime is liable to be charged with, covering Indian citizen or person of Indian origin, the exception to it are the military laws. Military as well as armed forces have a disparate dedicated list of laws. Any kind of military crime cannot be charged based on IPC. IPC does not have a privilege of superseding any part of it. To deal with such laws, an institute, a disciplinary mechanism, a separate legal department ‘JUDGE ADVOCATE GENERAL’ was created.
