(2 of 1974) , S.102(3), S.457— Property seized by police - Criminal courts have jurisdiction to dispose of the same - Facts that property was found abandoned at public place and it was not connected with any offence was immaterial. The criminal courts have jurisdiction to dispose of the property seized by the police even if it is found abandoned by the police at a public place and the property not being connected with any offence. In view of the @page-ALJ702 amendment in S. 102, Cr. P.C. Criminal Courts have been conferred with jurisdiction to dispose of the seized property by the police during investigation, enquiry and trial or otherwise. Thus, there is no infirmity in the order of the Sessions Judge in directing the release of a truck in favour of the registered owner when the claim of the revision petitioner on the basis of sale was found to be bogus.
