Constitution of India , Art.16— Pay scale - Determination - Respondent appointed as veterinary doctor on temporary post - After closure of Project he was adjusted as Administrative Officer as per Deployment of Surplus Staff Rules instead of dismissing him - Initially he was allotted to Scheduled Castes and Scheduled Tribes Commission - But later on was not assigned any duty there - Then he was allotted to Geological Department as Administrative Officer - He is entitled to pay scale payable to Administrative Officer in Geological Dept. - Order of Tribunal granting higher pay scale payable to Assistant Director in Scheduled Castes and Scheduled Tribes Commission - Is improper.
