(A) Constitution of India , Art.19(1)(a), Art.13(3)(a), Art.51A— National Flag hoisting by citizens on their premises - Is fundamental right qua freedom of 'Speech and Expression' - Duty to respect flag must be strictly obeyed - Executive instructions under Flag Code that same is impermissible - Are not reasonable restrictions - Executive instructions under Flag Code is not 'Law' within meaning of Art. 13 - Flag Code is not a statute and cannot regulate fundamental right to fly National Flag - Guidelines, however, laid down under Flag Code deserve to be followed to the extent it provides for preservations of dignity and respect for National Flag - No statute conferring right on citizen to fly national flag - Suggestion to enact given. Article 19(1)(a) of Constitution of India does not confer absolute right of free speech and expression. Unlike Constitution of United States of America Art. 19(1)(a) of Constitution of India only provides for a qualified right. Such a fundamental right of a citizen of speech and expression is subject to the regulatory measures contained in Cl. (2) thereof.
