(A) Constitution of India , Art.21— Scope - Fair and impartial investigation is facet of Art.21 - Person booked under criminal law - Has right to know the nature of allegations, so that he can take necessary steps to safeguard his liberty. Criminal P.C. (2 of 1974) , S.154— Fair and impartial investigation is a facet of Article 21 of the Constitution of India and presumption as regards the innocence of an accused is a human right. Therefore a person who is booked under criminal law has a right to know the nature of allegations so that he can take necessary steps to safeguard his liberty. It is imperative in a country governed by Rule of Law as crusaders of liberty have pronounced 'Give me liberty, or give me death'.
