(A) Rajasthan High Court Ordinance (15 of 1949) , S.47, S.46— Language to be used in High Courts - Judgments, decrees and orders - S.47 of Ordinance providing for all proceedings to be in Hindi - Rules framed by High Court under S.46 - After coming into force of Constitution, S.47 and rules not applicable - Art.348 of Constitution attracted. It is not correct to say that in view of S.47 of the Rajasthan High Court Ordinance, even after coming into force of Part XVII of the Constitution of India, all proceedings including judgments, decrees and orders of the High Court have to be in Hindi written in Devanagari Script. After coming into force of the aforesaid part of the Constitution so far as language of High Court is concerned, the relevant Chapter III, particularly Art.348 will apply and not S.47 of the Ordinance and Rr. 125 and 126 of the Rules framed thereunder.(Para 2) Assuming for the sake of arguments that the words 'all proceedings' in S.47 of the Ordinance includes judgments, orders and decrees, this position could continue till the coming into force of the Constitution of India.
