(A) Constitution of India , Preamble, Art.368, Part III— Basic structure doctrine - Provisions touch-stone, to test extent of Parliament power to amend Constitution - In application of the doctrine Part III plays a key role. (Para 101) (B) Constitution of India , Part III, Part IV— Fundamental rights - Have to be balanced with directive principles - Balance can be tilted in favour of public good - However, cannot be overturned by completely overriding individual liberty. (Para 102) (C) Constitution of India , Art.31B, Art.32, Preamble, Sch.IX— Protective umbrella of Art.31B - Scope - Does not totally abridge judicial scrutiny of laws placed in Sch.9 - Any law put in 9th Schedule - If infringes basic structure - Can be struck down. Since the basic structure of the Constitution includes some of the fundamental rights, any law granted 9th Schedule protection deserves to be tested against these principles. If the law infringes the essence of any of the fundamental rights or an other aspect of basic structure then it will be struck down.
