(A) Constitution of India Art. 16 — Appointment — No objection certificate (NOC) — To join as Senior Resident at Post Graduate Institute of Medical and Education Research — Rejection of — Petitioner serving as Medical Officer sponsored by authorities on his request, for doing Post Graduation in department of Hospital Administration — As per Clause 6.1 of policy, petitioner bonded himself to serve State for at least five years, including one year of mandatory field posting (outside Medical Colleges) — Petitioner, after completing Post Graduation, was undergoing his first year of field posting at Civil Hospital — Petitioner applied for issuance of NOC for joining as Senior Resident — Mere selection/appointment of petitioner as Senior Resident would not vest any right in him to flout terms and conditions of policy under which he was accorded permission to pursue Post Graduation outside State with full pay and allowances while maintaining his seniority and promotion — Rejection by authorities to grant NOC to petitioner, in view of bonds submitted by petitioner and in view of terms and conditions of policy, proper.
